How is annual leave calculated if I start mid-year?
If you start employment partway through the year, your annual leave is pro-rated based on the number of months you work. The formula is: (months worked ÷ 12) × 24 days. For example, if you start on July 1st and work 6 months, you get (6÷12) × 24 = 12 days of annual leave for that year.
Do public holidays count as annual leave?
No. Public holidays are separate from annual leave and do not reduce your annual leave balance. If a public holiday falls during your annual leave period, it should not be counted as a leave day.
Can I carry over unused annual leave to the next year?
Yes. Under Zambian law, you can accumulate unused annual leave for up to 2 years. After 2 years, the employer may forfeit the accumulated leave (though many companies allow longer accumulation periods by policy).
What happens to my leave when I resign or am terminated?
Upon termination of employment (whether by resignation, dismissal, or retrenchment), you are entitled to payment in lieu of any accrued but unused annual leave. This is calculated based on your current daily rate of pay.
How many sick days can I take without a medical certificate?
Under Zambian law, employers can require a medical certificate after 2 consecutive days of sick leave. However, many companies have policies requiring certificates for any sick leave. Check your employment contract.
Is maternity leave paid or unpaid?
Maternity leave in Zambia is paid at full salary for the entire 12-week period, provided you have completed at least 2 years of continuous service with the employer. If you have less than 2 years of service, you may still be entitled to maternity leave but the pay entitlement may vary.
Can my employer refuse my annual leave request?
Employers can reasonably schedule annual leave to avoid operational disruption, but they cannot unreasonably refuse leave requests. If there’s a dispute, the matter can be referred to the labour office or industrial relations court.
What is the difference between working days and calendar days?
Working days are days you would normally work (excluding weekends and public holidays). Calendar days include every day of the week. Annual leave in Zambia is counted in working days, while maternity leave is counted in calendar days (12 weeks = 84 calendar days).
How do I calculate my daily rate for leave payment?
Your daily rate is calculated as: Monthly Salary ÷ (working days per month). For a 5-day work week, this is typically: Monthly Salary ÷ 21.67 days (average working days per month). For a 6-day work week: Monthly Salary ÷ 26 days.
Does my probation period affect my leave entitlement?
No. You accrue annual leave from your first day of employment, including during probation. However, some employers may restrict when you can take leave during the probation period for operational reasons.
